COMMERCIAL PROPERTY

Richard Ablitt, the principal solicitor at Ablitts, runs the commercial property department. The work comprises two areas:

  1. Business Leases
  2. Conveyancing and Business sales

1 - Business Leases

We act for Landlords and Tenants in relation to the drafting and negotiation of leases and related documentation, such as contracts and Rent Deposit Deeds. We undertake on behalf of the tenant clients as full legal enquiries into the property as you may wish us to undertake, and advise you upon your rights and obligations and ensure the lease properly embodies the terms it should contain.

Business leases are frequently lengthy and complex documents which require care and skill as well as an ability by the solicitor to explain things in plain English to the client.

We are also sometimes instructed in relation to matters arising during the term of the lease, for example:

  • acting for a landlord in relation to considering and approving an assignment of a lease to a new tenant
  • exercising or resisting "break clauses"
  • disrepair issues
  • renewal of leases

2 - Conveyancing

We can act for you in the sale or purchase of business premises, freehold or leasehold, together with associated mortgage work.

Often the sale or purchase of a property may be part of a larger transaction involving the transfer of a business as a going concern.

Other transactions may involve the granting, taking or exercise of an Option Agreement, and there may be planning issues to which the transaction is subject.
